Terms of Service

These terms govern your use of Enacare — the app, the facility portal, and enacare.org. By creating an account or using the platform you agree to them. Plain language throughout; where a section has legal effect beyond the obvious, we say so.

1. What Enacare is (and isn't)

Enacare is a marketplace. Facilities post per-diem nursing shifts; licensed nurses claim and work them; we run the platform that connects the two, verifies credentials, tracks time, and moves payment. Nurses on Enacare are independent professionals, not Enacare employees. Nurses control whether, when, and where they work, and are responsible for their own licensure, professional judgment, and taxes (earnings are reported on a 1099 basis). Enacare is not a healthcare provider, does not supervise clinical work, and is not a party to the care delivered at a facility.

We can suspend or remove accounts that break these rules. Where the violation is money- or safety-related we may do so immediately.

6. Facilities

Facility accounts are created by invitation after review. Facilities agree to post only real, accurately described shifts, to review timecards and overtime requests promptly, and to pay applicable cancellation charges. Facilities are solely responsible for conditions at their sites and for their own compliance with employment, safety, and healthcare regulations.

7. Disclaimers and limits (the legally load-bearing part)

The platform is provided "as is." We work hard to keep it accurate and available but don't guarantee uninterrupted service, that shifts will be available, or that any shift will be filled. We are not responsible for the conduct of facilities or nurses, or for conditions at any facility. To the fullest extent permitted by law, Enacare's total liability for any claim arising from the platform is limited to the greater of $100 or the amounts we paid you (or you paid us) in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.

8. Ending an account

Nurses can delete their account in the app (Profile → Settings → Delete my account); facility accounts are closed via [email protected]. Deletion is handled as described in the Privacy Policy. Earnings already owed to you are still paid out. We may close accounts that violate these terms.

9. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and disputes belong in the state or federal courts located in Harris County, Texas.

10. Changes

If we change these terms in a way that matters, we'll update the date above and notify you in the app or by email before the change takes effect. Continuing to use Enacare after that means you accept the updated terms.
